Divorce often generates feelings of anxiety, fear, stress, and concern for clients facing the prospect of the breakup of a marriage. These feelings are completely normal and to be expected given the emotionally-trying nature of divorce proceedings. However, a diligent attorney can help you navigate this otherwise stressful and contentious divorce process.

Divorces can be either uncontested or contested. In either occasion, the issues of property division, alimony, child custody, and child support must be resolved.

Once a contested divorce is filed, the other spouse must be served with a copy of the Complaint for divorce. Once served, this spouse has thirty (30) days to file an Answer with the Court. Following the filing of an answer, the parties engage in discovery. This is a fact-finding process, by which each spouse can discover information relevant to the case for use at trial.

Generally, parties to a divorce must attend mediation prior to trial. Mediation can be an excellent tool in settling a divorce without the expense and effort of a trial. In mediation, the parties and their attorneys work with a neutral, third-party mediator to attempt to resolve the issues that a judge would otherwise decide.

If the divorce is not resolved at mediation, it will go to trial. Virtually all divorce trials are tried solely by a judge. The judge, in accordance with the law, will render decisions as to fault for divorce, division of the marital estate, alimony, child custody, and child support.
